Terms of Service

Fair rules for using Mail Audit.

These terms explain what Mail Audit provides, what users are responsible for, and the limitations of email-open tracking technology.

1. Acceptance of these terms

By accessing Mail Audit, signing in, installing the extension, or using its tracking features, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the service.

2. The Mail Audit service

Mail Audit is a Gmail-focused Chrome extension and web dashboard that adds an invisible tracking image to emails selected for tracking and reports supported image-load events as email opens.

Tracking is an indicator, not proof

Email clients may block, proxy, preload, cache, or repeatedly load images. Therefore, Mail Audit cannot guarantee that every displayed open represents a unique human view, or that an unopened status proves the recipient did not read the email.

3. Eligibility and accounts

  • You must be legally able to enter into these terms or use Mail Audit with authorization from your organization.
  • You are responsible for the Google account used to access Mail Audit and for activity performed through it.
  • You must provide accurate information and promptly report suspected unauthorized use.
  • You may not share authentication tokens, bypass access controls, or impersonate another person.

4. Lawful email tracking

You are solely responsible for determining whether email tracking is lawful and appropriate for your recipients and use case. You must provide notices or obtain consent where required by law, contract, employment policy, or organizational rules.

Mail Audit is a technical tool and does not provide legal advice. Your use must comply with applicable privacy, communications, anti-spam, employment, and consumer-protection laws.

5. Prohibited use

  • Unlawful surveillance, stalking, harassment, discrimination, or intimidation.
  • Spam, phishing, fraud, malware delivery, deceptive conduct, or unauthorized bulk messaging.
  • Tracking people where you know consent or notice is required but has not been obtained.
  • Interfering with Mail Audit, its infrastructure, security controls, or other users.
  • Reverse engineering or automated abuse except where applicable law expressly permits it.
  • Using Mail Audit to violate Gmail, Chrome Web Store, Google API, or other third-party terms.

6. Pricing and future paid features

Mail Audit may offer free features and may introduce paid plans later. Any price, renewal term, included usage, and refund rule will be shown before a user purchases a paid service.

Google is not the seller of Mail Audit services. Any future purchase relationship will be directly between the user and the Mail Audit operator or stated payment provider.

7. Availability and changes

We aim to keep Mail Audit useful and reliable, but the service may be interrupted by maintenance, provider outages, Gmail interface changes, browser updates, security incidents, or other circumstances.

Features may be added, changed, limited, or discontinued. Material changes affecting user data will be reflected in updated disclosures and, where required, presented for user consent.

8. Disclaimer of warranties

To the extent permitted by law, Mail Audit is provided on an "as is" and "as available" basis without warranties of uninterrupted operation, complete accuracy, merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of liability

To the extent permitted by law, the Mail Audit operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, opportunity, reputation, or business resulting from use or inability to use the service.

Nothing in these terms excludes liability that cannot legally be excluded. Mandatory consumer rights remain unaffected.

10. Suspension, termination, and updates

Access may be limited or terminated for abuse, security risk, legal requirements, policy violations, or conduct that harms users or the service. You may stop using Mail Audit at any time and request account deletion.

These terms may be updated as the product changes. Continued use after an updated effective date means you accept the revised terms where legally permitted.
